Investigations and Voluntary Disclosures

We have conducted many internal investigations and worked with companies to develop and implement the appropriate strategy to resolve those matters. In some cases, we have worked with our clients to make voluntary disclosures to the government.
Our lawyers frequently have responded to government investigations of all kinds, from audits to complex parallel civil fraud and grand jury investigations. Our goal is to meld substantive expertise in the subject matter under investigation with procedural expertise in the specific investigative agencies involved. Recognizing that companies which do business with government agencies have interests beyond the current problems, we work closely with company counsel and internal auditors not only to defend the matter at hand, but also to improve compliance and establish procedures to avoid future problems.
Significant engagements:
- In response to questions raised by DCAA while auditing contracts performed by our client, the Air Force launched an investigation of our client, and the Department of Justice threatened to sue our client for violations of the False Claims Act, TINA, and the Anti-Kickback Act. We conducted an extensive internal investigation at the client’s offices, provided the government white papers and other written responses, and made several formal presentations to the government rebutting the government’s allegations. The Department of Justice declined to pursue the matter and directed the Department of Defense to cease further investigative efforts.
